The Law:

 

lllnois Law and Liability:  

The Illinois Statute that covers most dog bites is the Illinois Animal Control Act - 510 ILCS 5/6 (1994).


The Statute states:

"If a dog or other animal, without provocation, attacks or injures any person who is peaceably conducting him or herself in any place where he may lawfully be, the owner of such dog or other animal is liable in damages to such person for the full amount of the injury sustained".

 

Damages:

The damages referenced in the statute may include compensation for the following:

 

Medical Expenses

Lost Wages

Pain and Suffering

Disability or Loss of Normal Life 

Emotional Distress

Disfigurement

Spouses Loss of Consortium

 

 

A person present during the dog attack, but not actually bitten, may also have a claim for damages for emotional distress.
